TERMS AND CONDITIONS FOR THE PROVISION OF SERVICES ELECTRONICALLY AND CONDUCTING SALES USING MEANS OF DISTANCE COMMUNICATION

Introduction 

The euroelectro.eu online store is operated by:
Audio Video Design Sp. z o.o. with its registered office in Warsaw at ul. Kurantów 34, (02-873) Warsaw, tel. no.: (22) 331 55 31, fax no.: (22) 331 55 00, entered into the register of businesses of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under number 0000141174, NIP [Taxpayer Identification Number]: 526-10-36-502, REGON [Polish National Business Registry Number]: 011254203, and with a share capital of PLN 105,000.00 paid up in full (hereinafter: „Service Provider”).

§1 Definitions

The terms used in these Terms and Conditions have the following meanings:

  1. Warehouse – the central warehouse located in Warsaw (02-873), at ul. Kurantów 34, in which orders placed by Clients are processed.
  2. Euroelectro Online Shop – retail stores operated by Audio Video Design Sp. z o.o.
  3. euroelectro.eu Online Store – the online store operated by the Service Provider, available at the following web address: www.euroelectro.eu
  4. Client – a natural person with full or limited legal capacity or a legal person or organisational unit without legal personality but with legal capacity that uses the euroelectro.eu Online Store and, in particular, makes purchases there.
  5. Consumer - a natural person conducting a legal act with a business that is not directly related to its business or professional activities, and a natural person who, conducting acts related to its business or professional activities, also acts for a purpose that is not related to such activities and this purpose is the primary purpose.
  6. Shopping Cart – a function of the euroelectro.eu Online Store in which the Client is able to view all products presented for purchase and in which it is possible to determine and modify information related to the order, including the number of products, delivery address, invoice information, the chosen method of payment, and the delivery method. The Shopping Card also allows for the entry of a rebate code.
  7. Rebate Code - a special string of numbers or characters that entitles the Client and/or the Client of a physical store to receive the specified Product rebate.
  8. Order - a declaration of will by the Client for the purpose of concluding a distance sales agreement through the Online Store, in which the type and number of Products is indicated.
  9. Product Page – a page of the euroelectro.eu Online Store on which information related to the offered products is provided.
  10. Payment Entity – an entity cooperating with the Service Provider as an agent in the performance of payments using payment or credit cards or by a wire transfer.

§2 General provisions

  1. The terms and conditions specify the terms and conditions regarding using the euroelectro.eu Online store, placing orders for the presented products, the shipping and delivery of the products to the Client, providing payment for the products, the Client’s rights regarding cancelling orders or withdrawing from agreements, as well as the terms and conditions regarding the submission and processing of claims.
  2. The following are needed to use the euroelectro.eu Online Store, view the content of the presented products, and to submit orders:
    1. a computer with access to the internet as well as a web browser that satisfies the following minimum technical requirements:
      1. Microsoft Internet Explorer version 8.0 or higher with ActiveX, JavaScript, and Cookies activated or
      2. Mozilla Firefox version 3.5 or higher with Java, JavaScript, and cookies activated or
      3. Google Chrome version 16.0 or higher with Java, JavaScript, and cookies activated or
      4. Opera version 10.0 or higher with Java, JavaScript, and cookies activated or
      5. Safari version 6.0 or higher with Java, JavaScript, and cookies activated,
      6. a minimum screen resolution of 1280 x 800 pixels,
      7. if documents are downloaded, software that can open PDF files such as Adobe Reader is needed.
    2. or a mobile device (phone or tablet) with internet access, that satisfies the following minimum technical requirements:
      1. Android version 2.3 or higher or
      2. iOS version 6.0 or higher or
      3. Windows Phone version 7.0 or higher,
      4. a minimum screen resolution of 480x800 pixels
    3. an active e-mail account.
  3. The Client has the right and obligation to use the euroelectro.eu Online Store exclusively in accordance with its purpose. The Client cannot send illegal content to the Service Provider through the Online Store.
  4. The Service Provider is not liable in the maximum extent permitted by law for any disruptions or interruptions in the operation of the euroelectro.eu Online Store caused by force majeure, the incompatibility of the Online Store with the Client’s technical infrastructure, and the unauthorised activities of third parties.
  5. The Client is not required to register in order to view the content and products of the euroelectro.eu Online Store and its use is free of charge.
  6. The placement of orders for the products presented in the euroelectro.eu Online Store does not require registration.
  7. The settlement of credit card and eTransfer transactions takes place through the settlement centre operated by PayU SA with its registered office in, 60-166 Poznań, ul. Grunwaldzkiej 182, entered into the register of businesses maintained by the District Court for Poznań – Nowe Miasto i Wilda in Poznań; Commercial Division of the National Court Register under number KRS 0000274399, with a share capital ofi 4.944.000 PLN, paid up in full, and NIP: 779-23-08-495, REGON 300523444.

§3 Terms and conditions of using the euroelectro.eu Online Store

  1. The Service Provider is obliged to provide services through the Online Store in the scope and under the conditions specified in these Terms and Conditions.
  2. Any problems in the operation of the euroelectro.eu Online Store may be reported to the Service Provider through the Customer Service Centre.
  3. Claims related to the products can be submitted by the Client in accordance with the provisions of § 8 of these terms and conditions. Claims will be processed within a period of 14 days from the date of their submission.

§4 Product information

  1. The presented information related to the produces offered in the euroelectro.eu Online Store constitute an invitation to conclude an agreement in accordance with Article 71 of the Civil Code.
  2. The prices of the products are provided in PLN and include VAT.
  3. The prices of the products do not include the costs of shipping them to the Client which depend on the manner of delivering the ordered products to the Client and the value of the order, and are provided in the Shopping Cart during the selection of the delivery method by the Client.
  4. The total cost of ordering the products that includes the prices of the products and shipping costs is provided in the shopping cart before the placement of the order by the Client.
  5. The Service Provider reserves the right to change the prices of the products at any time, which includes conducting and ending promotional campaigns and clearance sales, where these changes will not affect orders placed before the date of the change of the price or the conditions of promotional campaigns and clearance sales.
  6. Promotional discounts in the euroelectro.eu Online Store cannot be combined, unless provided otherwise in the terms and conditions of the given promotional campaign.

§5 Order processing

  1. Orders can be placed by the Client for products that are available in the offer of the euroelectro.eu Online Store seven days a week and 24 hours a day.
  2. The Service Provider will only process Orders with delivery in Poland.
  3. In order to place an order in the euroelectro.eu Online Store, the Client should:
    1. Select a product by clicking “Details” to view detailed information about the product, and then clicking “Add to cart”;
    2. Select the product delivery method or the option to pick the product up in person;
    3. When placing an order, the Client will be able to enter a Rebate Code if one was obtained by the Client, ex. from a store advertisement, newsletter, or other sources in which the Service Provider carries out promotional activities;
    4. Enter the data of the recipient of the order and the address to which the product is to be delivered, the invoice information if a VAT invoice is to be issued for the Client, a telephone number for contact with the courier, as well as an e-mail address;
    5. The Client will be able to enter his or her own remarks related to the processing of the order in the “Remarks” field. The information entered in this field will be delivered to the Customer Service Centre together with the order;
    6. Click on the “Confirm Purchase” button in the order summary, which is tantamount to an obligation provide payment in the manner provided by the euroelectro.eu Online Store. The above also applies in the case of payments made in cash upon delivery of the shipment.
  4. The Client will provide payment for the ordered products in accordance with the method chosen by the Client: cash upon delivery, wire transfer, or using the eCard electronic payment system before delivery.
  5. If the Client chooses to pay in advance, the Client should pay the value of the order using one of the payment methods provided for in the system. The ordered product can be delivered to the Client in the manner of his or her choosing:
    1. By courier to the address provided by the client in the order;
  6. The Service Provider does not conduct wholesale sales and reserves the right to limit the amount of a given product that can be covered by a single Order.
  7. The placement of an Order by the Client is tantamount to the sending of an offer for the conclusion of a sales (purchase) agreement regarding the ordered product to the Service Provider.
  8. The Service Provider reserves the right to limit the delivery and payment methods in regard to select products or amounts of ordered products. In the event of such a limitation, the Service Provider will notify the Client of it prior to the placement of the Order.
  9. In the event of the lack of the ordered product in the Warehouse or the inability to process the Client’s Order for other reasons in the time provided for the processing of the Order, the Service Provider will promptly notify the Client of this fact by sending an e-mail to the e-mail address provided by the Client in the Order or by telephone to the number provided by the Client.
  10. In the event of the lack of the ordered product in the Warehouse or the inability to process the Client’s Order for other reasons in the time provided for the processing of the Order, the Service Provider will promptly notify the Client of this fact by sending an e-mail to the e-mail address provided by the Client in the Order or by telephone to the number provided by the Client.
  11. In the situation where it will not be possible to process a part of an order, the Service Provider can offer the following to the Client:
    1. The complete cancellation of the Order – should the Client make this decision, the Service Provider will be released from the obligation to process the order;
    2. Processing a part of the Order and cancelling the part that cannot be carried out in the designated period of time - should the Client make this decision, the Service Provider will be released from the obligation to process the remaining and undelivered part of the order;
    3. Divide the Order and specify a new period for the processing of the part that cannot be processed in the initially specified period – should the Client make this decision, the shipping of the ordered products will be delivered into separate parts, and the Client will not bear any additional costs related to this in excess of the cost that was initially specified for the processing of the Client’s entire Order;
    4. In the case where the Client fails to select one of the manners of processing the Order specified in subsection 11 of this section, the Service Provider will deliver those products to the Client that can be delivered on time, while the rest of the order will be cancelled, of which the Client will be notified in an e-mail sent to the e-mail address provided in the Order. The Client can withdraw from the agreement in the scope in which it was performed in accordance with the terms specified in § 11 of the terms and conditions;
    5. In the event of the inability to contact the Client for reasons for which the Service Provider is not at fault in the situation described in subsection 10 of this section or when the Client fails to make any decision, the Service Provider reserves the right to cancel the Order in full;
    6. In the event of the cancellation of the Order when payment for the ordered products was provided by the Client in advance, the Service Provider will refund the amount paid by the Client under the terms specified in § 12 of the terms and conditions;
    7. In the event where the Client provides incorrect data, in particular, an incorrect delivery address, the Service Provider will not be liable for non-delivery or late delivery in the maximum extent permitted by law.

§6 Payment methods

  1. Clients can pay for orders in one of the following manners:
    1. When picking up the ordered products from the Denon Salon Firmowy retail store chosen by the Client – in cash or using a payment card in one of the payment systems accepted by the Service Provider in the given moment
    2. Before picking up the ordered product – payment in advance – by wire transfer or using a payment card in one of the payment systems accepted by the Service Provider in the given moment;
    3. Upon delivery of the product to the address provided by the Client – in cash (cash on delivery – the maximum amount is 6500 PLN).
  2. The processing of the Order will take place after the receipt by the Service Provider of a confirmation of a properly performed payment from the payment entity or the proper placement of an Order using the cash on delivery option.
  3. The Client can pay for an Order in advance by selecting the wire transfer or credit card payment option.
  4. The Client cannot pay for a part of an Order in advance and then pay the rest upon delivery.
  5. The Client can use a valid Rebate Code obtained from the euroelectro.eu Online Store or another entity cooperating with the Service Provider. Rebate Codes are valid for a limited period of time during which they can be used. After its expiration, the Rebate Code ceases to be active and can no longer be used.
  6. A Rebate Code cannot be exchanged for a cash equivalent.
  7. A Rebate Code cannot be combined with any other Rebate Code or any other promotional discounts, unless the terms and conditions of the specific promotion provide otherwise.

§7 Order processing time

  1. The order processing time will be indicated in the Shopping Cart when placing the Order and confirmed in an e-mail sent to the Client. The content of the e-mail will constitute a confirmation of the acceptance of the Order. The delivery date may also be agreed upon in advance during a telephone call between an employee of the Service Provider and the Client.
  2. The Service Provider will make every effort to ensure the shortest possible delivery time for the Client taking advantage of authorised and reliable product suppliers. In most cases, unless agreed otherwise with the Client, an Order can be prepared for shipping on the business day following the date of the placement of the Order, which depends on product availability. The availability of products is indicated in the product details in real time allowing for their reservation in the Shopping Cart.
  3. The ordered product can be delivered to the address in Poland specified by the Client by courier.
  4. Delivery costs total, respectively:
    1. delivery by courier – free of charge for all orders.
    2. delivery by courier with cash on delivery – free of charge for orders for all orders.
  5. The Service Provider does not perform deliveries by courier on Saturdays, unless agreed upon otherwise with the Client.
  6. The Service Provider is not liable for the extension of the delivery time or for non-delivery in the case where the Client provided incorrect data, in particular, where the Client provided an incorrect delivery address.

§8 Claims

  1. A consumer has the right to submit a claim notice within a period of 24 (twenty four) months from the date of the delivery of the product.
  2. The company will process the claim within 14 (fourteen) calendar days and will notify the Client of any further steps that need to be taken.
  3. A claim for the removal of a defect or the exchange of an item that was sold for an item that is free of defects expires after one year from the date of the discovery of the defect.
  4. The condition for the processing of the claim by the Company is the delivery by the Client of the defective product together with its proof of purchase and a completed claim form. A sample of the claim form can be downloaded from here: Formularz zgłoszenia naprawy Thomson.pdf.
  5. If the item that was sold has a defect (does not comply with the agreement), the Client may demand its repair (removal of the defect) or exchange for a new item that is free of defects, the decrease of its price, or a full refund (withdrawal from the agreement).
  6. The Client cannot withdraw from the agreement if the defect is insignificant.
  7. If the Client is a consumer, the decision whether to demand repairs or an exchange for another item belongs to the Client, unless bringing the item to comply with the agreement in the manner chosen by the purchaser is not possible or would involve excessive costs compared with the manner proposed by the seller.
  8. The product to which the claim pertains, the proof of purchase, and a description of the claim should be sent to the address of the Warehouse.
  9. If the product was delivered and picked-up in person from a Denon Salony Firmowe store, the claim notice should be submitted in the same store from which the ordered product was picked-up.
  10. Should the claim be accepted, the Service Provider will, in accordance with the Client’s demand, repair or replace the product to which the claim pertains with a product that is in perfect condition, decrease the price of the product, or provide a full refund within a period of 14 (fourteen) days from the date of the acceptance of the claim.
  11. In the event of any objections regarding the manner in which the claim was processed, a consumer may:
    1. Submit a request to a Trade Inspection consumer arbitration court (proceedings free of charge);
    2. Request mediation before the Trade Inspection (proceedings free of charge);
    3. Request proceedings before the Consumer Rights Advocate (proceedings free of charge);
    4. File suit in a general court of law.
  12. A Client purchasing a product for a purpose related to its professional or business activities has the right to submit a claim notice in accordance with the appropriate provisions of the law in this regard, with the reservation that the liability of the Service Provider under the warranty for the physical defects of the product is limited to the amount that the Client paid to the Service Provider for the given product.

§9 Warranty

  1. The products offered by the euroelectro.eu Online Store are brand new.
  2. The euroelectro.eu Online Store is obliged to deliver the ordered products to the Client free of any defects, i.e. in accordance with the description provided on the store’s website.
  3. The products offered by the Service Provider are covered by the warranty of the seller or distributor, the conditions of which are specified on the enclosed warranty card. Unless specified otherwise, the standard warranty period for the products offered by the euroelectro.eu Online Store is 24 months from the purchase date. Regardless of the seller’s warranty, some products may additionally be covered by the manufacturer’s warranty, the specific conditions of which will be specified on the warranty document provided with the given product. The exercise of the rights arising out of the manufacturer’s warranty will not limit the ability to exercise the rights arising out of the warranty.
  4. In the event where the product fails to comply with the agreement, the Client may exercise its warranty rights. In such a case, a claim notice should be submitted in accordance with the provisions of § 8 of the terms and conditions.

§10 Order cancellation and withdrawal from the agreement

  1. The Client may cancel an order that was submitted until the products have been prepared for shipping by contacting the Customer Service Centre.
  2. A consumer may withdraw from a sales agreement regarding a product purchased from the euroelectro.eu Online Store without providing a reason for doing so within a period of 14 calendar days from the date of the receipt of the product, in accordance with the provisions of Article 27 of the Act on consumer rights dated 30 May 2014.
  3. A consumers will be liable for a decrease in the value of an item that results from its use in a manner that is beyond what is necessary to determine the nature, characteristics, and functions of the item, and is obliged to pay to the Seller any possible costs that may arise out of this.
  4. A consumer will not have the right to withdraw from the agreement in the case of agreements:
    1. for the provisions of services, if a business fully provided the service with the clear consent of a Consumer who was notified, prior to the start of the provision of the service, that after the provision of the service by the business, the consumer will lose the right to withdraw from the agreement;
    2. in which what is provided are items that are not prefabricated, manufactured in accordance with the consumer’s specifications, or which serve to satisfy the consumer’s individual needs;
    3. in which what is provided are items that are delivered in sealed packaging which after opening, cannot be returned for health or hygienic reasons, if the packaging was opened after delivery;
    4. in which what is provided are items that after delivery, due to their nature, become permanently connected to other items;
    5. in which the consumer clearly requested that a business come and perform urgent repairs or maintenance; if the business additionally provides other services than those that the consumer requested to be performed, or provides other replacement parts that are necessary to perform repairs or maintenance, the consumer will have the right to withdraw from the agreement in regard to those additional services or items;
    6. in which what is being provided are sound or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery;
    7. for the delivery of digital content which is not recorded on any substantive media, if the performance of the delivery began upon the clear consent of the consumer prior to the expiration of the period for withdrawing from the agreement and after notifying the consumer by the business of the loss of the right to withdraw from the agreement.
  5. The withdrawal by the Client from the agreement requires the submission of a written declaration in the period specified in subsection 2 of this section. The Service Provider will refund the money that was paid by the Client, i.e. the price of the Product and the standard delivery cost within a period of 14 calendar days from the date of the delivery of the notice and the return of the ordered item.   6. The Service Provider will not accept shipments sent as cash on delivery and is not liable for the costs related to such shipments.
  7. The costs of returning the product as a result of withdrawing from the agreement will be borne by the Client.
  8. In case of cancellation of the contract and refusal to accept the pay on delivery shipping customer will be obliged in accordance with Art. 34 §2 of the Act on consumer rights to return the actual and direct costs of the return shipment.

§11 Refunds

  1. Refunds of the amount paid by the client will be provided within 14 (fourteen) calendar days in the case of:
    1. The cancellation of the order;
    2. The return of a product as a result of a withdrawal from the agreement;
    3. The acceptance of a claim and the inability to perform repairs or exchange the product for a new one.
  2. The Service Provider will refund the amount paid by the Client:
    1. To the Client’s bank account related to the Client’s credit or payment card if payment for the order was provided in advance by wire transfer or using a credit card or upon delivery by courier;
  3. The amount to be refunded to the customer in the event of cancellation of the contract (in the case of in advance payment) and refusal to accept by the Customer of the goods sent to him, will be diminished by a deduction of direct cost of returning goods which, in accordance with Art. 34 §2 of the Act on consumer rights and §11 of these Regulations, shall be paid by the customer.

§12 Promotional discounts and clearance sales

  1. Information may be provided on the website of the euroelectro.eu Online Store regarding promotional discounts related to the Products in each and every case on the pages of the appropriate products.
  2. The products offered in the Sale tab are products whose lower special price may be due to the fact that:
    1. The product may be from an older series;
    2. The Store or Distributor is planning to no longer sell this product;
    3. The product was on display.
  3. A promotional discount may require entering a rebate code when placing an order, in such a case, the discount will not be visible on the product page but only when finalising the Order in the Shopping Cart.
  4. Promotional discounts cannot be combined with other promotional discounts in the euroelectro.eu Online Store unless this is explicitly permitted.
  5. In the case where the Client ordered a promotional package, the cancellation of the Client’s order referred to in § 11 can only pertain to the entire promotional package.

§13 Used electronic equipment

  1. The Service Provider informs that in accordance with the Act dated 29 July 2005 on used electrical and electronic equipment (Dz.U. of 2013 item 1155 as amended) the user of household equipment is obliged to return used equipment to an entity that collects used equipment of that type. The retail seller is obliged to accept used equipment free of charge when selling new household equipment in an amount that is no greater than the amount of the newly purchased equipment if the used equipment is of the same type.
  2. In accordance with the abovementioned legal provisions, when purchasing electrical and electronic equipment from the euroelectro.eu Online Store:
    1. The Client has the ability to return used electrical and electronic equipment in an amount that is no greater than the amount of the newly purchased equipment if the used equipment is of the same type. The return of the equipment may take place in a Denon Salony Firmowe store if the Client decided to pick the order up from a specific store or by delivering it at the Client’s own expense to the address of the Warehouse.
    2. Information regarding other collection points for used household electrical and electronic equipment that operate in the given municipality is provided by the municipal authorities on the websites of the given authorities or in the manner that is applicable in the given municipality.

§14 Newsletter

  1. The Client may provide consent to the electronic receipt of commercial information by checking the appropriate option field on the website.
  2. If the Client provides consent, the Client will a euroelectro.eu Online Store newsletter will be sent to the e-mail address that was provided, i.e. commercial information sent by the Service Provider on its own behalf and at the request of third parties.
  3. The Client has the right to cancel the receipt of the newsletter at any time independently by clicking the “cancel newsletter” option in the footer of the newsletter that was received or through the Customer Service Centre sklep@euroelectro.eu.

§15 Final provisions

  1. Product information presented on the website of the euroelectro.eu Online Store does not constitute an offer within the meaning of the Civil Code.
  2. The Service Provider will make every effort to ensure that the product information reflects the current factual state and functions of all products. At the same time, the Service Provider stipulates that there some writing errors may occur in the product descriptions. The photographs of the products are merely examples provided for presentation purposes.
  3. All product names used on the euroelectro.eu Online Store website are provided for identification purposes and may be legally protected and reserved.
  4. The Service Provider is not liable for any possible technical problems or limitations, including the data transmission speed, that may arise in the computer equipment, terminal, ICT system, or telecommunications infrastructure used by the Client, and which prevents the Client from properly using the euroelectro.eu Online Store.
  5. The Service Provider is not liable for the consequences of the use of the euroelectro.eu Online Store by the Client in a manner the violates the current provisions of the law, these terms and conditions, or the applicable customs in this regard.
  6. The Service Provider reserves the right to suspend or terminate the provision of services in the euroelectro.eu Online Store, in particular, to conduct maintenance or expand technical infrastructure, in the case where this will not violate the rights of the Client.
  7. For all matters not covered by these terms and conditions the provisions of Polish law will apply, in particular, the provisions of the Civil Code, the Act on the specific conditions of consumer sales and on the amendment of the Civil Code, the Act on the protection of certain consumer rights as well as on liability for damages caused by dangerous products, the Act on consumer rights, as well as the Act on the prevention of unfair market practices.
  8. Any and all possible disputes that may arise between the Service Provider and a Client that is not a consumer in accordance with the provisions of the Civil Code will first be resolved amicably, and if this will not be possible, they will be resolved by the court with jurisdiction over the registered office of the Service Provider.
  9. The Service Provider reserves the right to amend the terms and conditions for legal, organisational, or technical reasons. The amendment of the terms and conditions takes place on the date on which their new version is published on the euroelectro.eu Online Store website. Orders placed by Clients before the entry into effect of the new terms and conditions will be processed in accordance with the provisions of the terms and conditions that were in effect on the date of the placement of the Order.

§16 Privacy policy

  1. This section specifies the terms for the processing and protection of the personal data of the Clients of the euroelectro.eu Online Store.
  2. The administrator of the personal data of the Clients within the meaning of the Act dated 29 August 1997 on the protection of personal data (Dz. U. of 2014, item 1182 as amended) is the Service Provider i.e. Audio Video Design Sp. z o.o. with its registered office in Warsaw (02-873), ul. Kurantów 34 , tel. no.: (22) 331 55 55, fax no.: (22) 331 55, entered into the register of businesses of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under number 0000141174, NIP: 526-10-36-502, REGON: 011254203, and with a share capital of PLN 105,000 paid up in full.
  3. For the purpose of processing Orders, the Service Provider collects the following data related to the Client: first and last name, e-mail address, telephone number, address of permanent residence, delivery address for the issuance of an accounting document, business name, and NIP in the case of businesses.
  4. The Service Provider declares that providing the data marked in the euroelectro.eu Online Store as required is voluntary, through necessary for the purpose of processing the Client’s Order.
  5. The personal data of the Clients that is collected for the purpose of processing the Order and ensuring the proper operation of the euroelectro.eu Online Store is processed by the Service Provider with the Client’s consent expressed by providing the appropriate consent for the processing of personal data as well as for the purpose of:
    1. Selling products to Clients and providing services related to their delivery;
    2. The possible enforcement of claims;
    3. Determining the circumstances of the unauthorised use of electronically provided services;
    4. The creation of reports and analyses by the Service Provider related to the operation and the site visit statistics of the www.euroelectro.eu Online Store;
    5. Further improving and adapting the Online Store to Client needs.
  6. If the Client provides separate consent, the Client’s personal data may be processed by the Service Provider:
    1. For marketing purposes related to the business of the Service Provider as well as marketing purpose related to the businesses of entities cooperating with the Service Provider, and especially for the purpose of organising promotional campaigns, contests, and carrying out other marketing activities;
    2. To send commercial information to the Client, in particular, the ordered electronic newsletter.

  8. The Service Provider uses Cookies to collect information related to the use of the www.euroelectro.eu Online Store by Clients. The Service Provider declares that has entrusted the processing of the personal data of the Client or the other data referred to in the Privacy Policy to the entities that provide hosting, maintenance, and management services related to the Online Store to the Service Provider on the basis of a written agreement concluded in accordance with Article 31 of the Act on the protection of personal data.
  12. The Service Provider declares that has entrusted the processing of the personal data of the Client or the other data referred to in the Privacy Policy to other entities that provide services that are necessary for the processing of the order, the processing of a claim, and to use the financial services that are available in the Online Store directly to the Client or to the Service Provider on the basis of a written agreement concluded in accordance with Article 31 of the Act on the protection of personal data (ex. couriers, financial institutions).
  13. The Client has the right to access the content of the Client’s personal data, to correct it, and to demand the cessation of the processing and the removal of the data. For this purpose, an e-mail must be sent with the abovementioned demand to sklep@euroelectro.eu.
  14. In the case where the Service Provider requests consent for the electronic sending of commercial information, ex. by e-mail, the person that provides the abovementioned consent is entitled to withdraw it. For this purpose, the Client should:
    1. Click on the link that withdraws consent which is placed in the text of the commercial information or send an e-mail to sklep@euroelectro.eu entering “Cancellation” in the title, or send written notice regarding the withdrawal of consent for the receipt of commercial information to the address of the Service Provider;
    2. b. The Service Provider declares that it makes every effort to provide Clients with the highest level of security in regard to the use of the Online Store. Any and all events that affect the security of the exchange of information should be reported to the Service Provider by sending an e-mail to sklep@euroelectro.eu.
